New salary thresholds

 

Please note that the new salary thresholds have been published in the Belgian Official Gazette.

Regarding the notice period and the non-competition provisions for white-collar workers, the new amounts are the following as from January 1st, 2012:

  • Annual salary = EUR 31.467 : “Low-grade” white-collar workers
  • Annual salary > EUR 31.467 and = EUR 62.934 : “Higher” white-collar workers
  • Annual salary > EUR 62.934 : “Highest” white-collar workers

Regarding the probationary period for white-collar workers, the new amounts are the following as from January 1st, 2012:

  • Annual salary = EUR 37.721 : Maximum 6 months
  • Annual salary > EUR 37.721 : Maximum 12 months

The new amounts determining the required minimum gross salary of a foreign employee (for work permit) are the following as from January 1st, 2012:

  • Highly qualified employee :  EUR 37.721,00
  • Direction personnel : EUR 62.934,00
